either visitor accommodation or permanent residential living. This was a logical approach, which
meant that market forces would largely dictate what uses would occur on this land.
The subject land was included in the Special Facilities Zone Special Facilities in accordance with Plan
of Development No. 46, in July 1996 for a resort development. Part of the approval required
approximately 30 hectares of land adjacent the eastern boundary to be dedicated as National Park.
The land was dedicated as National Park prior to the site being included in the Special Facilities
Zone.
The rezoning approval allowed for the development of visitor accommodation for 400 persons with
a maximum of 169 units, plus 8 shops, 3 restaurants, resort management office, guest activities and
entertainment, information centre and sport and recreation facilities. The maximum building height
allowed was 2 storeys and 8 metres, with a maximum gross floor area of 12,330m². The table below
provides a break down of the approval.

A condition of the rezoning approval required connection to Council’s sewer infrastructure across
the Noosa River, subject to appropriate state agency approval being obtained. A key requirement of
this Plan of Development is for accommodation units to be 2 units per building comprising 90-
100m² each, effectively being a cabin, which is important for reasons provided below.
With the commencement of the Noosa Plan 2006, the Special Facilities Zone over the land was at an
end along with the 1997 Strategic Plan. The land was subsequently included in the Visitor Mixed Use
Zone. At the time the abovementioned preliminary approval was applied for, the subject land was
included in the Special Facilities Zone and was subject to the 1997 Strategic Plan.
5. Relevant Planning Provisions
Pursuant to section 314 of the Sustainable Planning Act 2009 (SPA), the application is to be assessed
against the following:
• the relevant State planning regulatory provisions;
• the South East Queensland Regional Plan 2009-2031;
