PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 28 APRIL 2015
REPORT
1. PROPOSAL
The application seeks a Development Permit for a Material Change of Use for 2 new
industrial tenancies with a total gross floor area of 200m2, located behind the existing service
station at 1 Factory Street, Pomona.
The existing service station has a gross floor area of 260m2 and includes 3 bowsers facing
the Factory and Hill Street frontages, with a vehicle service yard located along the eastern
boundary of the site. The proposed development retains the existing service station use and
proposes 2 new adjacent tenancies. The locality plan, site plan, elevations and site photos
are included as Attachments 1 – 4. Details are as follows:
Each tenancy is 100m2 in size, with tenancy 1 adjoining the existing service station
building along its northern perimeter, and tenancy 2 along the western perimeter.
Both proposed tenancies include a nil setback to the western property boundary with
the Majestic Theatre.
Suspended floor construction (approximately 1m above existing natural ground levels)
allowing for flood waters to pass under the building.
A 4.4m high fire rated wall along the western boundary with the Majestic Theatre.
Weatherboard cladding to walls.
Colorbond roof sheeting with 5° roof pitch.
Wheelchair accessible ramps along the tenancy frontages.
Aluminium framed glazing and doors.
A total of 8 on-site car spaces, with 3 new spaces in front of tenancy 2 fronting Factory
St, 3 new spaces in the northern corner of the site adjacent to tenancy 1, and 2
existing spaces in the eastern corner of the site adjacent to Hill Street.
2. SITE DETAILS
2.1. Background
The site has existing use rights to operate as a service station and motor vehicle workshop.
The use was established prior to the commencement of a planning scheme for Noosa Shire
and therefore operates as an established lawful use. An associated Environmentally
Relevant Activity (ERA) approval has been issued for Motor Vehicle Workshop and
Chemical Storage on the site.
On 26 June 2006, Council issued an approval for a boundary realignment (06/1097) to
rectify encroachments of the neighbouring Majestic Theatre building. The boundary line is
now 0.2m from guttering attached to the south eastern wall of the Majestic Theatre, and 1m
away from the theatre’s north eastern wall.
2.2. Site Description
The subject site is located at the southern end of Factory Street at the junction of Factory
Street, Hill Street and Subway Avenue, Pomona. The site has 21m of road frontage to
Factory Street and 39m of frontage to Hill Street. Both roads are State controlled. The site is
also adjacent to Cooroora Creek Parklands, is relatively flat and floods periodically.
The site is prominent and marks the eastern entry into Pomona’s commercial precinct.
2.3. Surrounding Land Uses
The site adjoins the Majestic Theatre along its western boundary. The theatre is promoted
as the oldest authentic silent movie theatre in the world and the longest continuously
operating movie theatre in Australia. The theatre is listed on the QLD Heritage Register and
mapped by The Noosa Plan’s Heritage Overlay.
