In terms of setbacks, while the proposal does not meet the deemed to comply solution offered by
the code’s acceptable outcomes, the proposal does meet the corresponding performance outcome
of the code. The reduced setbacks are proposed to minimise disturbance to the site and the lake,
with the structures located clear of existing vegetation and well away from surroundng dwellings.
The reduced setbacks also enables the structures to be located outside the mapped flood affected
area and sensitively sited away from the lake’s foreshore, maintaining the visual amenity of the
lake.
While the shipping containers are not of a high quality built form, their format is reasonable given
the temporary nature of the use on the site. Existing vegetation on the site and in the road reserve
will also assist to screen these structures and protect the natural character and visual amenity of
the lake subject to this vegetation being supplemented with some additional planting. A conditon
is recommended requiring the structures to be finished in colours that blend with the natural
landscape.
On cessation of the use of the site, all structures, hardstand areas and fencing will need to be
removed from the site and the disturbed areas rehabilitated including removal of weeds.
4.3.3 Recreation Activities Code
The proposal is consistent with the outcomes of the Code with the site suitable for its intended
purpose and supported by adequate infrastructure and servicing having regard to its temporary
nature. The proposal is also of a type, scale and intensity that will maintain the character of the
area and will not negatively impact on the amenity of the surrounding area in terms of operating
hours, noise, privacy and lighting emissions.
