L01 Statement to NSC

As the proposal does not comply with the setbacks the proposal is required to be assessed against the
Performance Outcomes PO9 which is provided below:

      PO9 Buildings and structures are designed and sited to:

            a) provide a high level of amenity to users of the subject site and adjoining premises,
               including provision of visual and acoustic privacy and access to sunlight; - The proposed
               reduced front setback is consistent with the location of the existing dwelling on site which
               currently located close to the street frontage as detailed in the photograph below.




                The proposed setback and design is also considered consistent with the surrounding
                streetscape which features garages and fences located along the front boundary.
