REPORT
Delegations are the process by which the Council delegates its local government powers to
another person (CEO or subordinate) to carry out or implement and enforce legislation and
standards. The Act authorises Council to undertake procurement and contracting activities
provided in the Regulation for its Local Government Area. The context and structure for
conducting these activities is outlined in the Procurement Policy.
The Act also permits Council, by resolution, to delegate a power contained within the Act, or
another Act, to the CEO. The proposed delegation passes to the CEO the powers to conduct the
procurement and contracting activities outlined below as well as making payments for
established contracts.
The delegated powers created include (in brief) to:
invite written quotes, tenders and expressions of interest for medium sized ($15,000 -
$200,000) and large sized (greater than $200,000) in a financial year or over the proposed
term of the contracts (note: all amounts are exclusive of GST).
Example: large sized contract - A contractual arrangement for the supply of a service over a 5
year period that is expected to be worth, exclusive of GST, $80,000 each year has a total
expected value of $400,000.
make, enter into, amend or discharge contracts;
establish legislative exceptions including supplier arrangements;
authorise payments;
authorise the issue of purchase cards;
authorise statutory payments and specific system payments; and
determine authority limits for Council officers.
The delegation and policy will be effective from the date of Council’s resolution and subject to
annual reviews. The CEO will further delegate necessary powers to appropriately qualified
Council officers. It is anticipated there will be occasions when the CEO chooses not to exercise
the delegation or is required to seek Council’s approval. The proposed delegation will be
administered in accordance with Council’s Procurement Policy and subject to internal and
external audit reviews.
