         Under the relevant overall outcomes for the Earthworks code:
            a) the earthworks will be designed and constructed to be structurally sound (OO(a));
            b) all onsite works will provide for land stability with further geotechnical advice is to be
                obtained and submitted with a development application for operational works (OO(b));
            c) the subject site does not contain contaminated land (OO(c));
            d) there are no flooding and drainage issues on the subject land, and the stormwater
                management for the proposed development has been addressed with stormwater to be
                managed using the existing internal lake system in the golf course (Lot 3 on
                SP178340)(OO(d));
            e) the proposed earthworks will not adversely impact upon groundwater, watercourses, or
                wetlands (OO(e));
            f) the loss of some native remnant or regrowth vegetation is unavoidable. The development
                will have some impact upon NJKHT’s for which an environmental offset is to be provided.
                Having regard to the advice provided by Gondwana Ecology (refer TEA – Appendix B)
                the proposed development will not have a significant impact upon ecological values given
                to the existing level of disturbance and the site and vegetation being isolated and
                segregated from the surrounding Noosa National Park (OO(f)).

         The proposed development will require earthworks across a relatively large portion of the site,
         much of which has been previously disturbed. The proposed development will not unreasonably
         impact on the natural environment having regard to the TEA (discussed above). The proposed
         earthworks will not adversely impact upon other properties and will provide a safe and secure
         work environment.

         The proposed development is consistent with the Earthworks Code or could be conditioned to
         comply with the assessment benchmarks. The extent of earthworks to be undertaken on site will
         be addressed with a further development application for operational works.

         Water Quality and Drainage Code

         With respect to stormwater management and maintaining water quality, the existing stormwater
         drainage infrastructure within the adjoining golf course site (Lot 3 on SP178340) is privately owned
         and maintained by the applicant. The existing Noosa Springs Golf and Spa Resort facilities utilise
         the existing onsite stormwater drainage system, as an integrated development. It should be noted
         that under covenant, the facilities and infrastructure on the subject land and the golf course are
         treated as an integrated development, and these allotments are unable to be sold separately.

         The Engineering Report (Appendix D) advises the existing infrastructure has the capacity to
         convey the stormwater from the proposed development. Upgrades to the internal drainage
         network will be undertaken as required. The increase in flows from the development will not cause
         adverse impacts or actionable nuisance to surrounding properties.

         Significant capture of stormwater runoff is achieved in existing constructed waterbodies within
         the golf course. Harvested rainwater is utilised for irrigation of the Noosa Springs Golf Course.
         The Engineering Report advises the existing constructed waterbodies provide frequent flow
