(a) | the Development proposes adequate parking spaces;
                      (b)   the parking spaces sought is in excess of the provisions of the relevant code;
                             and
                      (c)   the increased number of parking spaces requested is not required as a
                             consequence of the Development.
                37.   Conditions 35 d and e, 37 d and e and 40 should be amended to reduce the number of
                       parking spaces to be provided.
                Conclusion
                38    The Application should be approved subject to the Impugned Conditions being
                       amended or deleted as set out above in this Notice of Appeal.
