i. which would adversely impact the occupation and use of buildings and the site by the
residents; or
ii. which would result in the residential development preventing or inhibiting the conduct
of existing land uses.
c) are attractive and consistent with the developed character of the particular neighbourhood;
d) retain the natural landscape character and visual quality of hill slopes and ridgelines;
e) offer high levels of amenity, safety and security for the occupants;
f) have an adequate supply of water;
g) where not in a sewerage service area, effluent disposal systems are designed and sited to
minimise adverse effects on the environment; and
h) avoid adverse impacts on environmental values including environmentally sensitive areas.
The proposed development is consistent with the specific outcomes, overall outcomes and purpose
of the Detached House Code.
Other development codes such as the Engineering Works Codes are also relevant; however have
also be satisfied given the nature of the proposed use within an existing development.
Consequently, these other codes do not need to be considered further.
7. Key Planning Issues
The key planning issues relevant to the assessment relate to the following:
• the current use of the land;
• the intentions under the former preliminary approval;
• the appropriateness of the current development;
• other Visitor Mixed Use Zones;
• impacts upon amenity; and
• economic benefit.
These key issues are discussed below.
7.1 Current Use of the Land
The subject land forms part of a number of parcels of land either adjoining or in close proximity to
one another, that were the subject of a preliminary approval and sought an integrated mixed use
development. This development was to provide primarily visitor accommodation and other facilities
for tourism purposes in accordance with the Noosa North Shore Eco-Tourism Portal Development
Code. A number of subsequent development permits issued for the construction of the eco-cabins
(dwellings) on the subject land as well as other facilities to be provided on the North Shore Hotel
land described as Lot 2 on RP135678.
The preliminary approval has now lapsed and is at an end. It is understood that the development
company responsible for the development of the land under the preliminary approval fell into
receivership with parts of the land subsequently being sold separately. Consequently, it is highly
unlikely that the development envisaged under the preliminary approval will ever be realised.
